NEC President: July 29-Election Is Legal

President of the National Election Committee (NEC) H.E. Sik Bun Hok has re-affirmed that the July 29- National Election is legal.

At the official launch of the organisation process of the 6th legislature National Election in Phnom Penh on Tuesday, H.E. Sik Bun Hok explained his affirmation based on the legal and jurisprudence aspects, according to a NEC’s press release.

The NEC president laid stress on the NEC’s constitutionality and regarding the absence of the former Cambodia National Rescue Party (CNRP) dissolved by laws in November 2017, he said that based on the spirit of the new Article 76 of the constitution, there is no discrimination for small or big political party or ruling or opposition party, all political parties have the equal right to run for election. “This article does not mention at all that the election is (considered) just only with the (presence) of the former CNRP,” he underlined.

For the observers, he added, the Article 10 of the Law on Election of Members of the National Assembly stipulates that associations or NGOs “can” send their respective representatives to observe the election, but the word “can” means that “can or cannot” and the law does not state that the election must have election observers.

Concerning the turnout rate, he continued, it is the people’s right to go or not to the polls in Cambodia. According to thorough research on countries in Europe, he stressed, no country and no constitution states that an election can be annulled due to low turnout rate.

Cambodia will organise the sixth general elections on July 29, 2018, and NEC has already announced the period for the political campaign that will fall from July 7 to 27.
